If you are convicted of sexual assault or sexual abuse, you will face serious and life-altering consequences, including jail or prison time and mandatory sex offender registration. Do not speak with police officers or prosecutors — this will only hurt your case. You need immediate legal advocacy from a respected, professional criminal defense attorney.
Sexual Assault
Under Arizona law, sexual assault involves "intentionally or knowingly engaging in sexual intorcourse or oral sexual contact with any person without consent of such person." A.R.S. Section 13-1406. Sexual intercourse is broadly defined as "penetration into the penis, vulva, or anus by any part of the body or by any object or causing a person to engage in such contact." A.R.S Section 13-1401. Sexual assault carries a sentence of a minimum of 5.25 years to 14 years imprisonment for offenders with no criminal history. If the victim is a minor, the sentences increases dramatically and may be up to lifetime imprisonment.
As many know, these cases frequently revolve around the issue of consent and whether the client had knowledge of the alleged lack of consent. Oftentimes, there are evidentiary questions surrounding the circumstances of an alleged act of sexual assault. An investigation of all of the circumstances preceding and following an alleged acts of sexual assault is critical to the defense of these types of cases.
